In this paper I analyse the problem of legal disagreements, initially raised by Ronald Dworkin against Hartian positivism. According to Dworkin, disagreements are pervasive, since law is an argumentative practice in which participants invoke normative arguments. Positivists, who claim that law depends upon agreement among officials, have difficulties to make sense of the fact that lawyers frequently disagree. I first present the main arguments in the debate. I then go on to distinguish different levels at which lawyers disagree. Taking these (...) levels into consideration, I articulate a pluralist reply that shows that the fundamental positivist tenets remain untouched by Dworkin’s challenge. (shrink)

En una de sus versiones, el problema viene dado porque el positivismo asume que los conceptos jurídicos son criteriológicos, por lo que el desacuerdo entre juristas carece de sentido al ser una disputa meramente verbal. Plunkett y Sundell han ofrecido una respuesta novedosa a esta crítica que sostiene que no hace falta compartir un concepto para discrepar con sentido. Objetivo: El siguiente artículo tiene como propósito la revisión de la literatura existente cuyo enfoque sea las herramientas tecnológicas utilizadas para el abordaje del paciente con síntomas de salud mental, de manera virtual, para describir las ventajas, la eficacia, la efectividad y los beneficios de estas herramientas, a partir de la literatura encontrada. Métodos: se realizó una búsqueda en las bases de datos Pubmed, Elsevier, UpToDate, Journal of Medical Internet Research y Google Académico. Se identificó un total de 58 artículos (...) que versan sobre la eficacia y efectividad de las diferentes modalidades digitales (tales como aplicaciones, cuestionarios en línea, mensajes de texto, etc.) que tratan la salud mental. Resultados: la búsqueda realizada arrojó un total de 58 artículos. Tras la eliminación de duplicados, el número fue de 50 artículos. Después de la caracterización de la información basada en la revisión de la totalidad del contenido, fueron elegidos 30 artículos para que sirvieran como base para la construcción de la síntesis de datos. Conclusiones: las herramientas virtuales utilizadas en salud mental ofrecen un sin fin de beneficios para prestar un servicio con un acceso más sencillo a la población, de forma económica y efectiva, sin temor a que los pacientes sean estigmatizados al momento de buscar ayuda, como se pudo evidenciar en los artículos presentados. Además, las herramientas digitales utilizadas en psiquiatría han demostrado ser eficaces y seguras, sin embargo, son de reciente aparición y cuentan con una cantidad limitada de estudios que demuestren objetivamente su eficacia en esta área. This paper has two objectives: first, to rebut three misconceptions about the philosophy of Gilles Deleuze that deal with his position in ontology, aesthetics and science; and second, to probe deeper into two of these misunderstandings in order to discover their current scope. Both of these misunderstandings regard his views on ontology and on science. Here we will see how an ontology of difference and an intensive science arise. We explore two ways of distinguishing the semantic operation of kind terms. First, we focus on a distinction between terms with a flexible versus terms with an inflexible semantics. Flexibility depends on whether some changes in the domain of application are taken to be possible while being consistent with past usage and what is intuitively the same meaning. On the other hand we discuss terms whose mode of operation is tolerant, in that the cohabitation in the speakers’ community of more (...) than one use or practice of use of the term in question is accepted. Those terms contrast with terms that operate in a strict way restricting severely the legitimacy of different uses that cut the domain of application in different ways. Among the latter we include terms with an ethical component and terms whose correct application involves high stakes. These distinctions are not new, since the phenomena that we identify as flexibility and tolerance have been observed, although in our view they have not been properly systematized and assessed. We argue that the two distinctions throw light on the bases of some disputes and on some legal disagreements. (shrink)

In this work we examine critically how two competing approaches to meaning account for disagreements. We will argue that Hart's conventionalist stance does not commit him to descriptivism. That non-descriptivist theories of reference, properly understood, can account for a vast array of cases of interpretive disagreement and that and that an account of different kinds of disagreement can be provided from a conventionalist perspective within the framework of non-descriptivist theories of reference.

The concept of convention has been used in different fields and from different perspectives to account for important social phenomena, and the legal sphere is no exception. Rather, reflection on whether the legal phenomenon is based on a convention and, if so, what kind of convention is involved, has become a recurring issue in contemporary legal theory. In this book, some of the foremost specialists in the field make significant contributions to this debate. In the first part, the concept of (...) convention is analysed. The second part reflects on whether the rule of recognition postulated by Hart can be understood as a convention and discusses its potential and limitations in order to explain the institutional and normative character of law. Lastly, the third part critically examines the relations between conventionalism and legal interpretation. Given the content and quality of the contributions, the book is of interest to those wanting to understand the current state of the art in legal conventionalism as well as those wanting to deepen their knowledge about these questions. El artículo que se presenta tiene entre sus propósitos valorar las tendencias contemporáneas de la superación en liderazgo docente en Latinoamérica, así como de los principales (...) modelos y teorías donde se incluye además, una estimación de los diversos estilos de liderazgo y su importancia para el logro de un rol transformador en el docente de la educación superior. Quality higher education institutions have the characteristic to develop a pedagogy of change. Since 1999, the Education Regional Office for Latin America and the Caribbean established a program of the educative leadership net, in order to create a critical group of professionals of the educative system, pioneers in transformational leadership. One of the main purposes of the following article is to assess contemporary trends of the bettering processes in teaching leadership in Latin America, as well as, the main models and theories. Las naciones y pueblos indígenas presentan preocupantes índices respecto a la salud, así como otras carencias como la pérdida de sus tierras, la alimentación, la educación y, en general, el ejercicio de sus derechos, consagrados por organizaciones internacionales como la ONU y la OMS-OPS. En Ecuador, de acuerdo con el orden jurídico constitucional, se han instrumentado políticas de salud que incluyen el lineamiento general de un enfoque intercultural de la atenciónprimaria que incorpora los saberes y prácticas ancestrales. The ontogeny of the vertebrate retina has been a topic of interest to developmental biologists and human geneticists for many decades. Understanding the unfolding of the genetic program that transforms a field of progenitors cells into a functionally complex and multi‐layered sensory organ is a formidable challenge. Although classical genetic studies succeeded in identifying the key regulators of retina specification, understanding the architecture of their gene network and predicting their behavior are still a distant hope. The emergence of next‐generation sequencing (...) platforms revolutionized the field unlocking the access to genome‐wide datasets. Emerging techniques such as RNA‐seq, ChIP‐seq, ATAC‐seq, or single cell RNA‐seq are used to characterize eye developmental programs. These studies provide valuable information on the transcriptional and cis‐regulatory profiles of precursors and differentiated cells, outlining the trajectories that connect each intermediate state. Here, recent systems biology efforts are reviewed to understand the genetic programs shaping the vertebrate retina. (shrink)

Background:Decision-making and assessment in emergency situations are complex and result many times in ethical conflicts between different healthcare professionals.Aim:To analyse and describe situations that can generate ethical conflict among nurses working in emergency situations.Methods:Qualitative analysis. A total of 16 emergency nurses took part in interviews and a focus group.Ethical considerations:Organisational approval by the University Hospital, and informed consent and confidentiality were ensured before conducting the research.Result/conclusion:Two categories emerged: one in ‘ethical issues’ and one in ‘emotions and feelings in caring’. The (...) four ethical subcategories are presented: Autonomy, the first sub category: first, the nurse’s ability to practise care on an emergency ward and, second, to support the patient and/or relatives in terms of care and medical treatment. The conflicts arise when the nurse ends up in the middle between the patient and the physician responsible for the diagnosis and treatment from a nature scientific perspective. Reification of injured body: patient was often reified and fragmented, becoming just a leg or arm. Different factors contributed in this perspective. Pain: pain relief was often inadequate but more effectively treated in the emergency medical services than at the emergency department. The nurses highlighted the phenomenon of suffering because they felt that pain was only an object, forgetting the patients’ care need, like separating mind from body. Death: the nurses felt that the emergency services are only prepared to save lives and not to take care of the needs of patients with ‘end-of-life’ care. Another issue was the lack of ethical guidelines during a cardiac arrest. Resuscitation often continues without asking about the patient’s ‘previous wishes’ in terms of resuscitation or not. In these situations, the nurses describe an ethical conflict with the physician in performing their role as the patient’s advocate. The nurses express feelings of distress, suffering, anger and helplessness. (shrink)

The figure of chiasmus, which plays a key role inside Merleau-Ponty’s thought, makes it possible to address the way Castoriadis defines the imaginary throughout his entire work from a new perspective, as well as to shed light on some complexities concerning the relation between instituted and instituting. Tthis article emphasizes the intertwining of three pair of concepts, each of which corresponds to a different but yet interrelated aspect of his philosophy: psyche-society, tradition-innovation, and autonomy-heteronomy.

In this text, I consider two examples in the history of emancipation and manumission of enslaved, Black populations in the Caribbean and South America in order to theorize a colonial mode of conceiving of freedom at play in the first half of the nineteenth century. This mode is marked by the figure of the promise, enacting a notion of freedom as a constantly deferred, external compensation. Indeed, instead of an immediate decision deeming the practice of enslavement and trade of human (...) beings unacceptable, and an effective liberation of the enslaved Black populations in these different emancipation proclamations, the various histories of manumission in Latin America and the Caribbean show a long series of political and legal attempts to reduce and limit the extent of the slave trade that deferred the process of liberation for decades. Moreover, in many of these territories the practice did not end with the official proclamation of emancipation but was continued by illegal practices and mutations into legal forms of exploitation and oppression that are still operative today. After outlining this first trajectory, reconstructing the promise of manumission in the historical examples of Martinique (as read by Édouard Glissant) and La Gran Colombia and the Republic of Nueva Granada (contemporary Panamá, Colombia, Venezuela, and Ecuador), I analyze a second mode of investigation in examples of individual and collective strategies of liberation coming from the enslaved themselves, as reconstructed by contemporary feminist scholars in South America. These strategies appropriate liberation not as a promise, but as a negotiation and calculation that begins with the enslaved’s resistance to their oppressive conditions and that ultimately depends on the external concession by juridical authorities. In the third section of the chapter, I read these practices not as marronage, as they are sometimes approached, but as a different mode of turning back to these glimpses of freedom that more effectively challenge the narrative of emancipation and, with it, the promise of manumission in our present. -/- . Addressed by a multitude of authors along the centuries, the question has been answered based on the different placements around juridical and political concepts like citizenship, sovereignty, authority or law. In this investigation, the doctrinal development carried out around the obligatory nature of the (...) civil norm for foreigners in Spanish scholasticism is going to be considered. Specifically, due to its thoroughness and depth, the doctrine done by Francisco Suarez is going to be critically analysed. Once the answer given in our author's doctrine to the question posed has been established, we will consider the possible influences in the Anglo-Saxon sphere. (shrink)

Sin embargo, la incorporación del tópico a gran parte de los textos de naturaleza política, así como en las declaraciones de derechos y tratados internacionales adoptados a partir de la II Guerra Mundial ha supuesto la constitucionalización del mismo. Consecuentemente, como término constitucional su interpretación queda a merced de los actores jurídicos designados para ello en el sistema político constitucional. Es por (...) ello, que, con el fin de determinar el contenido de significado actual del tópico ha de atenderse a las sentencias que interpretan la norma fundante. En este artículo, centramos nuestro estudio en la jurisprudencia del Tribunal Constitucional Español. L’enfant placé a souvent vécu des traumatismes qui ont impacté sa capacité à réguler ses émotions dans les relations interpersonnelles. Afin d’aider les assistants familiaux et les parents à mieux s’ajuster à l’enfant ont été instaurés des temps d’observation dans les conditions naturelles des interactions adulte-enfant qui ont été enregistrés en vidéo. Le vidéo-feedback a ensuite été utilisé avec chacun des adultes. L’exemple de Matthias montre comment ce dispositif a permis aux parents d’identifier les conséquences de leur comportement sur leur (...) enfant. L’exercice a été plus difficile pour l’assistante familiale davantage centrée sur ses besoins. (shrink)

1. Two Approaches to the EarthIn several postwar texts, the earth increasingly receives attention from Carl Schmitt.1 In The Nomos of the Earth, the most important of these texts, he refers to Friedrich Hölderlin, a much earlier, very different author, who also considers the subject of the earth. Even though the positions of both are, ultimately, quite similar, they maintain significant terminological differences. Schmitt and Hölderlin both employ the word “nomos,” but in very different ways. Hölderlin regards “nomos” as “law” (...) in the sense of “positive” norm or “Gesez.”2 This use of “nomos” as “Gesez” differs from a second notion of law as the meaning operating at the basis of what Hölderlin calls the “sphere.” The sphere is a meaningful whole in which man originally exists. Law is here the very relations of the sphere as a meaningful whole. Hölderlin calls it the law in a “negative” sense.3 This second notion of law by Hölderlin (negative law or law as the meaning at the basis of the sphere) coincides precisely with the Schmittian idea of “nomos” as an “order of meaning [Sinnreich],”4 what he also calls the law in an “ontonomous and existential” sense.5 The first use of law as “nomos” or “Gesez” by Hölderlin coincides with Schmitt’s use of “Gesetz”: of law as “positive” law. In this study I intend to prove that there is a close connection between ethical purposes of Environmental Philosophy as World Philosophy and the idea of sacred nature as part of the “world” in a phenomenological sense, which includes sacred space as defined in the philosophy of religion. The main points that intersect here are: the idea of sacred space; the perception of virtue in a sacred world; the beauty of creation: nature, life, human sensibility. The theoretical background of this (...) study contains points of view that express phenomenological, hermeneutic, theological, and aesthetic conceptions belonging to authors and exegetes such as Mircea Eliade, William E. Paden, David Cave, Ion Ianoși, Douglas Allen, Arnold Berleant, and Vincent Blok. I believe that the neglect of the environment-as-a-condition-of-life (the consequences of which can already be seen in ecological imbalances) is caused by, among other factors, the desacralization of human attitudes towards nature and the world of life. Few people still have a feeling of sacred nature or the aesthetic emotion of perceiving beauty in natural forms. The relationship with the environment and nature is reduced to its exploitation as a source of economic profit or as a way for spending free time, a source of personal comfort devoid of any spiritual significance. Surely we cannot go back to archaic religions or medieval Christianity, but we can reintegrate into our moral values something of those cultures’ admiration and respect for the beauty/sublimity of nature and the world as expressions of divine creation, as something sacred. Philosophical debates related to this retrieval and their dissemination could be part of solving the ecological problems of the contemporary world. (shrink)

En 1926, à côté de trois autres histoires, ce texte intégrera le corps d’Elpénor, déterminant l’ensemble, une collection de quatre textes écrits pendant dix-huit ans, le premier étant « Cyclope », écrit en 1908 ; le deuxième, « Sirènes », en 1912 ; le troisième en 1919 ; et le dernier en 1926, « Les nouvelles morts d’Elpénor (...) ». Quand « Cyclope » et « Sirènes » sortent respectivement chez Le Matin en 1908 et chez Paris-Journal en 1912 aucun d’entre eux ne mentionne Elpénor. Bref, c’est avec le développement des deux dernières histoires, que Elpénor, cette figure effacée chez Homère et absente dans les deux premiers textes de Giraudoux, vole la vedette. Este artículo analiza lo que nos cuentan las imágenes fotográficas en su reverso y en las huellas del verso, a través de las anotaciones, marcas o descripciones que contienen, que entregan información importante de su contexto de producción, de los sujetos u objetos fotografiados y de su trayectoria. Así, se configura un sentido apropiado de la imagen. Este artículo, pone el foco en imágenes fotográficas escolares porque representan un espacio de convivencia particular y de intercambio de experiencias que, en alguna (...) medida, se captura y resguarda en ellas. En los pliegues, en los bordes oscurecidos o desgastados, en los márgenes marchitos y en las marcas de óxido o de otros materiales, es posible también encontrar historias, restos de memorias, afectos y rostros en un contrapunto que va más allá de la motivación del fotógrafo para captar el instante en un encuadre específico. Para el análisis, se presentan algunas imágenes fotográficas pertenecientes al archivo escolar de un centro educativo de la ciudad de Talca en la región del Maule (Chile), pues permiten develar el significado familiar, mnemónico y comunitario que estas adquieren al reunirse en ese repertorio. Este valor igualmente se desprende de la observación del material oculto en el reverso y de las marcas del verso de las imágenes fotográficas. (shrink)

Type 2 diabetes has been considered a public health threat due to its growing prevalence, particularly in the older population. It is important to know the effects of psychosocial stress and its potential consequences for some basic cognitive processes that are important in daily life. Currently, there is very little information about how people with T2D face acute psychosocial stressors, and even less about how their response affects working memory, which is essential for their functionality and independence. Our aim was (...) to characterize the response to an acute laboratory psychosocial stressor and its effects on WM in older people with T2D. Fifty participants with T2D from 52 to 77 years old were randomly assigned to a stress or control condition. Mood and physiological responses to tasks were measured. In addition, participants completed a WM test before and after the stress or control task. Our results showed that the TSST elicited higher negative affect and greater C and sAA responses than the control task. No significant differences in WM were observed depending on the exposure to stress or the control task. Finally, participants who showed higher C and sAA responses to the stressor had lower WM performance. Our results indicate that medically treated older adults with T2D show clear, typical mood and physiological responses to an acute psychosocial stressor. Finally, the lack of acute psychosocial stress effects on WM suggests that it could be related to aging and not to this disease, at least when T2D is adequately treated. (shrink)

Optando por la retórica, Las Casas busca un modelo antropológico nuevo, distinto tanto del humanismo elitista, como del erasmismo voluntarista. En esta búsqueda quisiéramos poner énfasis, argumentando a favor de un resultado revolucionario a la luz de sus objetivos prácticos: cesar el homicidio y garantizar la libertad a los indios en cada aspecto de su vida. Desde aquí, nos referiremos a esta postura revolucionaria que bebe de Aristóteles y de santo Tomás, pero que es capaz de superarlos, a favor de (...) una defensa de lo propiamente humano, que estriba precisamente en reconocer que todas las comunidades tienen la posibilidad de realizarse autónomamente. Por esto, creemos que se puede hallar, en Bartolomé de las Casas, una importante contribución a la cuestión del reconocimiento, pero aún más, un importante punto de partida para los desafíos de una filosofía intercultural. Should Lesbian and women's events have policies banning sadomasochists or sadomasochistic acts? This question is being heatedly debated in the Lesbian community. In this paper, I examine the moral and political problems with sadomasochism from a Lesbian-feminist perspective, concluding that sadomasochism is antifeminist and antiliberatory for many reasons. Then, given this conclusion, I explore how events such as women's music festivals should determine their policies about sadomasochism.

Over the last decade, our appreciation of the importance of the nucleolus for cellular function has progressed from the ordinary to the extraordinary. We no longer think of the nucleolus as simply the site of ribosome production, or a dynamic subnuclear body noted by pathologists for its changes in size and shape with malignancy. Instead, the nucleolus has emerged as a key controller of many cellular processes that are fundamental to normal cell homeostasis and the target for dysregulation in many (...) human diseases; in some cases, independent of its functions in ribosome biogenesis. These extra‐nucleolar or new functions, which we term “non‐canonical” to distinguish them from the more traditional role of the nucleolus in ribosome synthesis, are the focus of this review. In particular, we explore how these non‐canonical functions may provide novel insights into human disease and in some cases new targets for therapeutic development. (shrink)

The aim of this research is to develop and validate a measurement scale for consumer’s perceptions of corporate social responsibility using the three-dimensional social, environmental and economic conceptual approach as a theoretical basis. Based on the stages of measurement scale creation and validation suggested by DeVellis and supported by Churchill Jr.’s :64–73, 1979) suggestions, five different empirical studies are developed expressly and applied to consumers of tourist services. This research involves 1147 real tourists from 24 countries in two different cultural (...) and geographical contexts. A three-dimensional 18-item scale is proposed for measuring consumer perceptions of corporate social, environmental and economic responsibilities. This paper presents the complete development of the scale, as well as the implications and limitations of the main findings and the managerial implications. (shrink)

Fazer a genealogia do poder nunca foi o propósito claro de Foucault. No entanto, a questão do poder foi tema recorrente em suas investigações a ponto de estudiosos do trabalho do filósofo sugerirem uma divisão e organização de seu trabalho a partir de três eixos teóricos. Dentro dessa perspectiva, a analítica do poder marcaria a trajetória filosófica de Foucault na década de 1970. De fato, até 1994, ano de publicação do conjunto de textos, entrevistas e conferências de Foucault no Dits (...) et écrits, a questão da analítica do poder era majoritariamente conhecida a partir de livros como Surveiller et punir e Histoire de la sexualité I: la volonté de savoir. Com o início da publicação dos cursos no Collège de France a partir de 1997 as interpretações a respeito da analítica do poder sofrem um alargamento. Mas é somente em 2015 que a totalidade dos cursos de Foucault no Collège de France foram publicados, abrindo um importante caminho para a investigação a respeito das primeiras reflexões a respeito do poder. No presente artigo procuramos mostrar como os primeiros passos da analítica do poder de Michel Foucault se dá a partir de um contexto gauchiste ainda configurado em termos de dinástica do saber. Nesse sentido, procuramos mostrar como o período da dinástica corresponde a um esboço teórico, tentativas primeiras de conceituação do poder, marcadamente desenvolvido em contraposição com o marxismo. Essa contraposição se dá sobretudo na recusa tanto do esquema marxista de infra-superestrutura, quanto do modelo contratualista de sociedade estatal. (shrink)

This article intends to analyze the implications of a hypothesis that extends Foucault's analysis of neoliberalism from its effects on modern democracy. For this purpose, Wendy Brown's recent work examines how neoliberal rationality affects democracy, transforms its imaginary and even its main subject, namely the demos. Brown points to two problems of the "neoliberalism's stealth revolution," namely that the neoliberal rationality transforms and undoes democracy by directly affecting its fundamental principle of popular sovereignty. Such transformation is made from the change (...) produced in the democratic imaginary and, mainly, from the transformation of the economic subject from a subject of interest to human capital, as well as the political subject, relegated to the background. From this first problem, we examine how they happen and what are the consequences of changing the democratic imaginary and its central political subject. The second problem pointed out by Brown deals with the interference of neoliberal reason in sovereign autonomy. The second part of this article seeks, therefore, to analyze the relationship between the sovereignty of the nation-state and the notion of popular sovereignty from the problem of the expansion of capital and the vulnerability of the frontiers and territory where citizenship is exercised. Una crítica de la epistemología_ de Alfred Sohn-Rethel entendida como inconsciente del sujeto transcendental, la cual pivota en torno al famoso término _abstracción real_ [_Realabstraktion_] como principio de síntesis social; y, por otro lado, medir someramente sus _alcances _y_ limitaciones _respecto de las nuevas lecturas de Marx, concretamente, de la crítica de la escisión del valor [_Wertabspaltungskritik_].
